Terms of Service

1. Service Description

Borgi is a mobile client application for accessing the Mastodon social network. Borgi connects to Mastodon instances operated by third parties. We do not operate a Mastodon server, host user content, or moderate content on any instance.

Borgi is developed and maintained by Gelotto ("we", "us", or "our").

2. Acceptance of Terms

By downloading, installing, or using Borgi, you agree to be bound by these Terms of Service. If you do not agree, do not use the app.

3. User Responsibilities

• You are responsible for your Mastodon account and all activity conducted through it.
• You must comply with the rules and terms of service of the Mastodon instance(s) you connect to.
• You must not use Borgi to engage in any activity that is illegal, harmful, or violates the rights of others.
• You are responsible for maintaining the security of your device and account credentials.

4. Intellectual Property

Borgi, including its design, code, and branding, is the intellectual property of Gelotto. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

5. No Warranty

Borgi is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The app will be uninterrupted, timely, secure, or error-free.
• The app will be compatible with all Mastodon instances or server configurations.
• Any defects will be corrected.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Gelotto shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or profits, arising out of or in connection with your use of Borgi, whether based on warranty, contract, tort (including negligence), or any other legal theory.

This includes, without limitation, damages arising from:

• Content posted or received through Mastodon instances.
• Actions taken by Mastodon instance operators (e.g., account suspension, data loss).
• Interruptions or outages of third-party services (Mastodon instances, Firebase, network providers).

7. Third-Party Services

Borgi relies on third-party services including Mastodon instances, Firebase (Google), and your device's operating system. We are not responsible for the availability, accuracy, or policies of these services. Your use of these services is subject to their respective terms and privacy policies.

8. Termination

You may stop using Borgi at any time by uninstalling the app. We reserve the right to discontinue the app or any part of it at any time without notice.

9. Changes to These Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the app after changes constitutes acceptance of the updated terms.

10. Governing Law

These terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
